Another issue we recently covered in one of the last CFR’s is heavy
hospital beds with thin wheels with a crown on them creating indenta-
tions and ruts in vinyl flooring. The beds exert more static and rolling
load forces than the flooring is capable of resisting, yet the indenta-
tions and ruts are blamed on the installation and everything else other
than what’s actually causing the problem.
Manufacturers making suggestions for something, such as a test
method, and then denying a claim because the suggestion wasn’t fol-
lowed. The key word here is suggestion which means, an idea or plan
for consideration not a mandate. Mandate means a command or or-
der and denying a claim because you didn’t use it. If you suggest
something, such as a particular test and an alternative test is conduct-
ed such as one for moisture, you can’t deny a claim based on a sug-
gested test that wasn’t conducted when an industry recognized
